Training Program Terms & Conditions

Effective upon registration — applies to all athletes, programs, and digital products.

These Terms & Conditions govern your use of the Tier1Athlete website and your registration in Tier1Athlete training programs, including Speed Development, Hurdle Training, and drop-in sessions. By registering an athlete and completing payment, you agree to all terms below. The same agreement is presented for signature during registration.

1. Program Overview

By enrolling in a Tier1Athlete program, I acknowledge that my child ("the athlete") will participate in structured athletic performance training, including but not limited to sprinting, speed development, hurdle mechanics, plyometrics, strength training, and sport-specific drills. All training is conducted by Justin Wickard ("Coach Wickard") and any designated Tier1Athlete staff, assistants, or independent contractors.

2. Certification of Physical Fitness

I understand and agree that:

  • Athletic training involves inherent risks, including but not limited to sprains, strains, fractures, orthopedic injuries, concussion, heat illness, cardiac events, serious bodily injury, paralysis, or death.
  • My child will follow all safety rules, training protocols, and coach instructions at all times.
  • My child must immediately report any pain, discomfort, dizziness, nausea, difficulty breathing, or any other medical concern to the coach.
  • I am responsible for disclosing any medications my child is currently taking, including inhalers, EpiPens, or any prescription that may affect physical performance.
  • I have an ongoing duty to notify Tier1Athlete of any changes to my child's health status, new diagnoses, surgeries, or injuries that arise after initial registration.

By registering, I certify that my child:

  • Is not under medical restriction for any condition that limits participation in strenuous physical activity
  • Is not recovering from an injury that would prevent safe participation
  • Has no history of fainting, seizures, major heart issues, or exercise-induced conditions unless disclosed in writing
  • Is healthy and physically able to perform strenuous athletic training

Tier1Athlete recommends that all athletes obtain a physical examination from a licensed physician before participation. This is strongly encouraged but not required.

3. Medical Consent

If my child becomes injured or ill during training:

  • I authorize Tier1Athlete and its staff to obtain emergency medical care, including calling 911, administering basic first aid, and transporting the athlete to the nearest medical facility if deemed necessary
  • I am responsible for all medical expenses, including ambulance, emergency room, and follow-up care
  • I understand that Tier1Athlete does not provide medical insurance, accident insurance, or supplemental health coverage of any kind
  • I will provide a current emergency contact phone number at the time of registration and update it if it changes

4. Liability Waiver & Assumption of Risk

I acknowledge that Tier1Athlete, Justin Wickard, and all staff, assistants, independent contractors, volunteers, and facility/venue owners or operators are not liable for injuries, accidents, illness, or damages that occur as a result of or in connection with training, travel to or from training, or presence at a training location.

I knowingly and voluntarily assume all risks associated with participation, including but not limited to injuries related to:

  • Physical exertion, overexertion, or fatigue
  • Sprinting, change of direction, jumping, or landing
  • Incidental contact with other athletes, coaches, or bystanders
  • Turf, track, field, or facility surface conditions
  • Strength, speed, hurdle, or plyometric equipment
  • Weather conditions, including extreme heat, cold, wind, rain, or lightning proximity

I, on behalf of myself, my child, and my heirs, release and hold harmless Tier1Athlete, Justin Wickard, and all affiliated staff, contractors, agents, and venue owners from any and all claims, demands, losses, damages, or causes of action arising from participation, except in cases of willful misconduct or gross negligence.

5. Payment, Billing & Refund Policy

To maintain fairness and program consistency:

  • All payments are non-refundable once processed
  • By enrolling in a monthly plan, the parent/guardian authorizes Tier1Athlete to charge the payment method on file for each scheduled installment — billed on the same calendar date each month through Stripe — and to reattempt any failed or declined charge until the balance is resolved. The parent/guardian is responsible for keeping a valid payment method on file for the duration of the plan
  • Missed sessions cannot be credited, transferred, or refunded
  • If a payment fails, the parent will be notified and given 5 business days to resolve the balance. A $25 late fee will be applied to any payment not resolved within this period. If it remains unresolved after that period, registration privileges may be suspended as described below
  • Enrollment in a monthly/installment plan is a commitment to complete that program's scheduled payments. Installment billing is a payment convenience, not a right to cancel. Discontinuing attendance — for any reason — does not stop the scheduled monthly billing or cancel any installment that has come due; any missed or unpaid installment remains owed until it is paid
  • Payments apply to the registered program only and may not be transferred to another athlete or program without written approval
  • Tier1Athlete reserves the right to suspend or terminate an athlete's participation for non-payment
  • Any unpaid or outstanding balance must be paid in full before an athlete may register for, or participate in, any future Tier1Athlete program, season, or drop-in session. Registration and enrollment privileges are suspended while a balance remains outstanding and are reinstated once it is paid in full
  • Drop-in sessions are paid per session through the payment methods provided (currently Venmo or Zelle) and are due before or at the session. An athlete with an unpaid drop-in balance may not attend additional sessions until the balance is settled
  • Tier1Athlete may remove athletes for safety or behavioral reasons without refund

6. Missed Sessions & Make-Up Policy

  • Missed sessions may be made up within the same training week only, subject to availability in an alternate session
  • If no alternate session is available during that week, the missed session is forfeited
  • Unused sessions after the applicable week are forfeited with no credit or carryover
  • Only sessions canceled by Tier1Athlete (due to weather, facility closure, or emergency) will be rescheduled
  • Parents and athletes are responsible for tracking and attending their chosen training days

7. Behavior & Dismissal Policy

Tier1Athlete may immediately remove any athlete (without refund) for:

  • Unsafe, disrespectful, or threatening behavior toward coaches, staff, or other athletes
  • Failure to follow the coach's instructions after being warned
  • Behavior that endangers themselves, other athletes, or bystanders
  • Repeated disruption of training sessions
  • Bullying, harassment, or discriminatory conduct of any kind
  • Violation of program rules or expectations as communicated by Coach Wickard

Dismissal decisions are made at the sole discretion of Tier1Athlete and are final.

8. Athlete & Parent Communication Consent

I authorize Tier1Athlete and Justin Wickard to contact both the parent/guardian and athlete via text message, phone call, and email for purposes including:

  • Training reminders and schedule changes
  • Weather cancellations and location updates
  • Performance feedback and technique instruction
  • Sprint or video analysis delivery
  • Payment reminders and billing communications
  • Program announcements and enrollment information

I also authorize Tier1Athlete to share training videos privately with the athlete and parent for coaching purposes, and to store such videos securely for analysis and improvement. All communication between Tier1Athlete and athletes will be strictly professional and training-related.

Parents may request copies of any coach-to-athlete communication at any time. Parents may revoke direct athlete communication in writing, after which all communication will be directed to the parent only.

9. Video, Photography & Social Media Permission

I grant Tier1Athlete permission to:

  • Photograph or video record my child during training sessions, competitions, or events
  • Use such media for advertising, marketing, educational, and promotional purposes across all platforms, including but not limited to the Tier1Athlete website, Instagram, Facebook, YouTube, TikTok, and any future social media platforms
  • Use my child's first name and likeness alongside such media for promotional purposes
  • Share instructional clips privately with the athlete and parent for coaching purposes

All media will be used respectfully and professionally. No media will be sold to third parties. This permission remains active unless revoked in writing. Upon written revocation, Tier1Athlete will make reasonable efforts to remove the athlete's media from future marketing materials, though previously published content may not be retroactively removed from third-party platforms.

10. Weather, Environment & Outdoor Conditions

Training may occur outdoors in a variety of weather conditions, including heat, cold, wind, light rain, humidity, and varying field or track surface conditions. Tier1Athlete will cancel sessions at its sole discretion when conditions present a safety risk (e.g., lightning, severe storms, dangerous heat index).

I am responsible for ensuring my child arrives prepared with adequate hydration, appropriate footwear, weather-appropriate clothing, and sun protection when applicable. Tier1Athlete is not responsible for illness or discomfort resulting from an athlete arriving unprepared.

11. Transportation & Supervision

Parents and guardians are solely responsible for transportation to and from training. Tier1Athlete is not responsible for the supervision, safety, or welfare of athletes before the scheduled start time of training, after the session ends, or while waiting for pickup. Athletes under 16 must have a parent or designated guardian present or available by phone during the entire session.

12. Data Privacy & Information Security

Tier1Athlete collects personal information, including athlete name, date of birth, parent contact information, medical notes, and payment details, for the sole purpose of administering training programs, processing payments, and communicating with families.

  • Personal data is stored securely using industry-standard encryption and access controls
  • Payment information is processed through Stripe and is never stored on Tier1Athlete servers
  • Tier1Athlete will never sell, rent, or share personal information with third parties for marketing purposes
  • Parents may request access to, correction of, or deletion of their family's personal data at any time by contacting Tier1Athlete in writing
  • Tier1Athlete may use anonymized, aggregate data (e.g., total athletes trained, program enrollment numbers) for marketing and reporting purposes

13. Dispute Resolution

Any dispute arising from or related to this agreement, the training programs, or the relationship between the parties shall first be addressed through good-faith negotiation. If the dispute cannot be resolved informally within 30 days, the parties agree to submit the dispute to binding arbitration administered in Collin County, Texas, under the rules of the American Arbitration Association. Each party shall bear its own costs and attorney's fees. The parties waive any right to participate in a class action, class arbitration, or consolidated proceeding.

14. Agreement & Acceptance

By completing registration and payment, I confirm:

  • I have read, understand, and agree to all Terms & Conditions outlined in this document
  • I voluntarily accept all assumptions of risk and liability provisions
  • I am the legal parent or guardian of the athlete being registered
  • I am at least 18 years of age
  • I agree that my electronic signature (typed name and checkbox) carries the same legal force as a handwritten signature
  • I understand this agreement may be updated by Tier1Athlete with 30 days written notice, and continued participation constitutes acceptance of updated terms
  • This agreement is governed by the laws of the State of Texas
  • If any provision of this agreement is found unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect

This agreement remains active for the full duration of the athlete's participation in any Tier1Athlete program and survives termination with respect to Sections 4 (Liability), 5 (Payment), 12 (Data Privacy), and 13 (Dispute Resolution). This agreement may be revoked only by written notice to Tier1Athlete.

Text Messaging (SMS) Program Terms

Program: Tier1Athlete account and billing notifications. By opting in during registration, you consent to receive recurring automated text messages from Tier1Athlete at the mobile number you provide, including schedule reminders, payment notices, and program updates.

  • Message frequency varies based on your account activity (for example, when a payment is due or does not process).
  • Message and data rates may apply.
  • Consent to receive texts is optional and is not a condition of registering for or purchasing any program.
  • To stop receiving texts, reply STOP at any time. You will receive a confirmation and no further messages.
  • For help, reply HELP, or call/text us at (817) 660-7751.
  • Carriers are not liable for delayed or undelivered messages.
